You arrive on Thursday, December 30, and find that the inventory procedures have just been started. You spot a railway car on the sidetrack at the unloading door and ask the warehouse superintendent, Buck Rogers, how he plans to inventory the contents of the car. He responds, “We are not going to include the contents in the inventory.”

Later in the day, you ask the bookkeeper for the invoice on the carload and the related freight bill. The invoice lists the various items, prices, and extensions of the goods in the car. You note that the carload was shipped December 24 from Albuquerque, f.o.b. Albuquerque, and that the total invoice price of the goods in the car was $35,300. The freight bill called for a payment of $1,500. Terms were net 30 days. The bookkeeper affirms the fact that this invoice is to be held for recording in January.

Your paper must include the following:

 

  1. A description of a business situation that presents a legal and ethical issue. The business situation must be from prior, current, or anticipated future employment experiences or from a current event. The description of the business situation must not exceed two pages.
  2. An analysis of the ethical concerns raised by the situation.
    1. Apply at least two different ethical theories to the situation to support at least two different outcomes.
    2. The paper must determine which ethical outlook as applied to this particular situation will result in the best legal outcome for the business.
  3. An explanation of at least three of the relevant areas of law that have been addressed in this course (e.g., constitutional law, contracts, anti-trust law, securities regulations, employment law, environmental law, crimes, or torts) and an assessment of the each area of law as it applies to the business situation identified.

Critical Essay

 What is the main theme of the story, and why do you think the author has chosen to write about it? ( The second part of this question is not easy to answer, and the author may not know – or entirely know – the answer either).

—  Is the theme embedded in a conflict? – a disturbance? – a problem? – a particular insight or ‘revelation’?

—  What aspects of form: style; specific choice of language; narrative voice (point of view) has the author employed to convey the story?
