QUESTION 1 (9 Marks)

Hoping to promote his struggling small business, Buster Brady placed the following advertisement in the January edition of

his local newspaper:

“Attention all fishermen and fisherladies of Keenanville!! Bring your bait and bring your tackle to Lake Kanchan this Saturday,

because local fishing shop “The Crabshack” is offering $10,000 to any person who catches “Big Joanna” – a 20kg Murray cod

which has been tagged and released into Lake Kanchan”

Tommy, a local homeless person who survives on the fish he can catch in the lake, was most surprised to see so many people

fishing at Lake Kanchan that weekend. Tommy, who was unaware of the advertisement, was even more surprised when, at

around 1pm, he caught a huge Murray cod which was tagged: “I am Big Joanna! Claim your $10,000 @ The Crabshack!”.

Still in shock about his win, Tommy was heard telling newspaper reporters that he was simply “..trying to catch something

for dinner… but caught $10,000 instead!”

Later that night, and still angry that Tommy won the $10,000 prize without actually participating in the competition, Buster

sent him the following sms:

“Sorry mate, changed my mind, no prize money for you today!”

Analyse each party’s rights in contract law (9 marks) (Hint: Only discuss the first three formation elements. You can ignore

element of Intention)

QUESTION 2 (11 Marks total)

After getting really good publicity when Tommy’s story appeared on that evening’s Channel 7 NEWS broadcast, Buster had a

new idea for bringing in more business. Buster called Tommy with the following offer:

“If you agree to appear in a television advertisement for ‘The Crabshack’, I will pay you $10,000 (paid in monthly instalments)

for your services” (**original contract**) Tommy accepted the offer and the advertisement was filmed the next day.

Unfortunately, the advertisement was not enough to get Buster’s business out of financial trouble and when, by June, Buster

had only made three payments totalling $3,000, Tommy was told that “Buster would not be able to make further payments

until the December holidaymakers brought more business to Keenanville”.

As a compromise, Tommy agreed to the following contract variation: “Buster, if you make one further and final payment of

$2,000, I will be willing to forgive the remaining $5,000 of the debt”. Buster happily agreed to this contract variation and

immediately made the “final” repayment of $2,000 under the new contract.

As luck would have it, the very next day, Buster won $5,000 on a poker machine at his local pub. Hearing of Buster’s win,

Tommy sent Buster the following sms:

“Sorry mate, changed my mind, no discount for you today! Let me know when I can expect to see the next monthly instalment

in my bank account as originally agreed”

(a) Assuming that the original contract was valid, analyse each party’s rights in relation to the new (varied) contract (7

marks)

(b) Would your answer be any different if Tommy had told Buster to pay the balance of the debt as a lumpsum payment? (4

marks) (Note: You must refer to case law AND legal articles/ journal articles here)

– Please see the “exercise outline” document that describes theDescriptionSolution downloadThe QuestionPlease see the “exercise outline” document that describes the steps needed to complete the formulas in the ratio analysis spreadsheet.? The income and balance sheet data have already been populated for 2014 and 2015.? Just need help with the formulas.Ratio Analysis1) Assume that you are a financial analyst updating this ratio analysis. Start by getting the latest data onIBM. Try ?http://finance.yahoo.com?>?Search Yahoo? for ?IBM?>Income Statements & Balance Sheet.Update tabs ?income? and ?balance? in your file with the recent data and the previous year?s data. THISDATA IS ALREADY POSTED TO THE SPREADSHEET.Note: As of 29 Feb 2016, the latest financial statements available via finance.yahoo.com on IBM is asof 31 Dec 2015. This is the data that you should use for this exercise. You are comparing 2015 to 2014.2) Also regard IBM’s current market data from Yahoo’s finance page. Take the price-per-share (pps)directly from Yahoo (the big bold unlabeled number on the Yahoo page) and enter it into your homeworkfile. Overwrite the date that you downloaded this data into the appropriate cells (see the old dates?).For the “Market to Book” ratio, take “Mkt Cap” from Yahoo, enter the value into your spreadsheet anddivide it by ?shareholders equity? from the balance sheet to get Mkt/Book. Also, get the E.P.S. data froma current page. For your ?PE ratio?, create a formula using the current pps and EPS data.3) As you update the various ratios, use Excel formulas with cell references, rather than typing in anactual value. For example use ?=B7/F5? rather than ?=B7/12?. For the calculated cells, you MUST use cellreferences in the formulas (and not actual values). The other advantage to using cell references in yourformulas instead of actual values is that your spreadsheet will be more functional ? if you change theinputs, the ratios will update automatically. There are very rare exceptions to this ?use cell references, not values? rule when the model actually contains a constant instead of a variable.Hint1: When working in the ?RATIO? tab, for example in cell B3, and you want to write a formula usingdata in the ?BALANCE? tab, the format is ?=balance!B8/balance!F6?Hint2: One method of checking your formula is to write the formula using the OLD sample data. Note ifthe results that you get are the same as the sample. If not, the error is in your formula. This suggestionis especially relevant for ratios for which there are alternative methods of calculation and for accountsthat go by several different names.Hint3: You might want to try building formulas in the income statement and balance sheet itself. Thisstep is not required, but may save you some points as it will sometimes pick up data entry errors thatotherwise go undetected.3) Notice column E in the ratio tab. These are brief comments regarding the change in the ratios andwhether they are going in a favorable direction. To say that a value is getting bigger or smaller is notsaying whether the firm is getting better or worse in the particular area that the ratio measures. Changethe comments to reflect the changes from 2014 to 2015. Your comments will be the real ?analysis?.
